Special rules for bicycles \r\n \r\nSection 49 It is not permitted to ride a bicycle next to another vehicle. Where there is sufficient space to do so, two cyclists may ride side by side if this can be done without danger or undue inconvenience. If the signal for overtaking has been given, cyclists are not permitted to ride side by side unless traffic conditions permit or necessitate this. Never ride a bicycle with three or more wheels next to another bicycle.
\r\n\r\n
Subsection 2 Cyclists should always keep to the right in the lane located to the far right in the direction of traffic. However, the lane next to it can be used when overtaking if it cannot be done to the right.
\r\n\r\n
Subsection 3 Before crossroads, the cyclist going straight ahead or turning left, regardless of Section 16 (1)(3) must continue to keep to the right on the road. However, if one or more lanes are reserved for road users turning right at the marking, the cyclists may position themself at the line between the nearest lane not reserved for right-turning road users and the right-turn lane. Cyclists wishing to turn left must continue through the crossroad to its opposite side, first making the turn when it can be done without inconvenience to traffic. This applies regardless of markings unless it appears that these apply to cyclists. Points 1-4 also apply when riding across or away from the roadway outside of the crossroad.

Subsection 4 Cyclists must always have both feet on the pedals and at least one hand on the handlebars.
\r\n\r\n
Subsection 5 It is forbidden to cycle on the pavement or footpath unless otherwise provided by the rules set by the Minister of Justice cf. Section 14(4). Cyclists may ride across pavements and footpaths.

Subsection 6 While riding, cyclists are not allowed to hold onto another vehicle or to the driver or passenger of another vehicle.

Subsection 7 When parking bicycles, it is recommended that the bike be locked unless the parking period is relatively brief.

Section 50 Children under the age of 6 are not allowed to cycle unless they are escorted by a person who is 15 years old or older.

Subsection 2 A bicycle may not carry more people than it is designed to carry. The Ministry for Transport may set rules on the transport of children by bicycle and persons in a trailer (bicycle trailer) or sidecar, including rules on the setup of the passenger’s seat and on the age of the cyclist.

Subsection 3 Bicycles must not carry objects more than 3m long or 1m wide. Objects that are carried must not prevent the cyclist from having full control of the bike or using the proper hand signals. Yes, it is healthy to e-bikes, according to a Norwegian study that has compared the health effects of cycling and e-bike.

In the experiment, eight people had to travel the same route on both regular and e-bike.

The measurements showed that all participants were moderately or intensively physically active 95 percent of the time – regardless of the bike they used. On the e-bike, participants used 51 per cent of their lung capacity and the regular bike used 58 per cent. This is equivalent to the fact that the e-cyclists were on average 8.5 times more active than at rest, and that ordinary cyclists were 10.9 times more active than at rest.

Professor of Public Health at the University of Agder, Elling Bere, is behind the study. He is surprised by the result: \"E-cycling provides good exercise, and I think that surprises many. Research shows that the e-bike leads to significant changes in transport habits.
\r\n\r\n
In a Norwegian study, the researchers first randomly divided selected individuals into two random groups. The 66 people in one group (the subjects) were allowed to borrow and use an e-bike freely for 2-4 weeks. The 160 remaining people (the control group) had to settle for their own bicycle with rye bread engine.
\r\n\r\n
Both groups kept a diary of their trips. In addition, the electric cyclists' kilometers were digitally recorded on the e-bikes.
\r\n\r\n
The results of the study show that the electric cyclists used the bikes much more than those in the control group. The daily tour number increased from 0.9 to 1.4 on average and the average trip length increased from 4.8 to 10.3 km.
\r\n\r\n
In general, the e-bikes made a marked difference in the transport habits of the study group. Before getting an electric bike, the subjects traveled 28% of their journeys by bicycle. After they got an e-bike, the figure had risen to almost 50%.

These terms and conditions apply to the rental of all Bycyklen bikes by Bikeshare. The terms and conditions apply from April 6th. 2020.

1. General
\r\n\r\n
Bikeshare rents out the bikes under the terms and conditions listed below. As a user, you are responsible for ensuring compliance with the terms and conditions during the entire rental, usage or subscription period.
\r\n\r\n
2. Registration and identification
\r\n\r\n
In order to use Bycyklen, you need to download Bycyklen app I App Store or Google Play. When you register as a user, you must provide the requested information and assign a valid payment card.
\r\n\r\n
You must select a username and PIN. You must not disclose your username or PIN to others. You are responsible for ensuring that the information provided is correct.
\r\n\r\n
You must be at least 18 years old to register.
\r\n\r\n
3. Different Price Options for renting a Bycyklen bike
\r\n\r\n
You can choose from a number of price options when you rent a Bycyklen bike.
\r\n\r\n
\r\n\t
Basic - Pay as You Go \r\n\tYou pay for pr. minute for renting the bike. \r\n\t
\r\n\t
Pre-paid packages \r\n\tYou can purchase a package that includes a certain amount of minutes. The pre-paid package expires after one year from date of purchase. The larger package, the lower price pr. minute.
\r\n
\r\n\r\n
The current prices are listed on bycyklen.dk.
\r\n\r\n
3.1 Special terms for subscriptions \r\nCannot be subscribed - the following applies to existing subscribers.
\r\n\r\n
Bikeshare reserves the right to change the prices and terms of subscriptions at one month's notice. In case of major changes, subscriptions may be terminated without notice.
\r\n\r\n
The down payment for your subscription will be deducted automatically from your payment card every month.
\r\n\r\n
3.2 Special terms for purchasing of packages \r\nWhen you purchase a pre-paid package, you can sign up for the automatic top-up facility. This means that you automatically purchase a similar package once you have used all the minutes available in your package. The amount is deducted from your payment card.
\r\n\r\n
If you are not signed up for automatic top-up and you run out of minutes whilst cycling, you pay the Basic price as informed in the app or at Bycyklen.dk
\r\n\r\n
4. Payment and deposit \r\nThe following methods of payment are accepted: Dankort, VISA, Mastercard, VISA Debit. All Bycyklen prices are listed at bycyklen.dk in Danish kroner and inclusive of VAT.
\r\n\r\n
When you have completed a trip, the price of the trip and any extra fees are automatically added to your invoice. All payments are transacted at the same time in order not to incur multiple fees for multiple payments.
\r\n\r\n
You are responsible for ensuring that a trip is ended in the correct so that payment stops. It is your own responsibility if the trip is not completed correctly.

As a consumer, you have the right of withdrawal under mandatory legislation. You may not exercise this right after you have commenced a trip.

You accept that any purchase of additional services during your trip via the app is binding and cannot be revoked. Bikeshare is entitled to automatically and directly deduct from your payment card any payment that you have accepted at bycyklen.dk or via the Bycyklen screen.
\r\n\r\n
5. Availability \r\nThe bikes are available at Bycyklen stations, at main traffic junctions and central locations selected by DSB, the City of Copenhagen, the City of Frederiksberg and Rødovre Municipality. You can find the Bycyklen stations in the app and on bycyklen.dk.
\r\n\r\n
6. Usage \r\nYou can rent a bike from a Bycyklen station via the app. You can find the Bycyklen stations in the app.
\r\n\r\n
For your own and others' safety, you must comply with applicable legislation, including criminal law and traffic regulations, when using the bike. You must pay particular attention to the fact that the Bycyklen is electric. You can find good advice on using electric bikes in the app and at Bycyklen.dk
\r\n\r\n
You must use the bike in an appropriate and responsible manner at all times. You will be held liable for any negligent or willful damage to a Bycyklen bike incurred during rental. See section 10 for more information.
\r\n\r\n
When parking the bike, remember to lock it.
\r\n\r\n
Use of bikes is at your own risk and Bikeshare holds no responsibility, except as specifically stated in these terms.
\r\n\r\n
Bikes may only be used within Denmark. Use of the bikes outside Denmark constitutes a material breach of these terms.
\r\n\r\n
7. Return \r\nIt is important that you return the bike in the same condition as it was when you started the trip.
\r\n\r\n
You can find the nearest Bycyklen station in the app and at bycyklen.dk. If no docking points are available, you can use the function \"Please return here\" in the app and leave the bike in the designated area.
\r\n\r\n
Note that if you choose to return the bike outside the designated area, you are deemed to have accepted the fee.
\r\n\r\n
If docking points are available and you return the bike next to the docking stand, Bikeshare will charge a fee. You can find information on the available docking points via the app.
\r\n\r\n
If you leave the bike in Copenhagen, Frederiksberg or Rødovre, but complete the trip correctly and leave the bike locked, Bikeshare will charge a collection fee. Information about the fee is available at bycyklen.dk.

If you complete the trip correctly but leave the bike outside Copenhagen, Frederiksberg, or Rødovre, Bikeshare will also charge a collection fee. Information about the fee is available at bycyklen.dk.
\r\n\r\n
8. Defects
\r\n\r\n
Before starting a trip, please check the bike for defects. Please report any defects to Bikeshare in order for the bike to be repaired for the benefit of other users. If the defect hinders you from using the bike, you must return the bike to a docking station. You will receive a refund for the trip in question once the problem has been confirmed by Bikeshare, unless the defect is due to circumstances for which you are responsible. If you return the bike to the same docking point within 3 minutes, you will be automatically refunded.
\r\n\r\n
When you use a bike, you thereby confirm that the bike has no defects at the time of rental.
\r\n\r\n
If you experience any defects whilst cycling, you must report them to Bikeshare in accordance with the requirements below. If the defect hinders use of the bike, please return the bike in accordance with section 8 above. You will be reimbursed a proportionate share of the rent for the trip in question once the problem has been confirmed by Bikeshare, unless the defect is due to circumstances for which you are responsible.
\r\n\r\n
All defects on the bike and at docking stations can be notified in the app, via e-mail (info@bycyklen.dk) or by telephone (+45 89 88 39 10).
\r\n\r\n
9. User responsibility \r\nYou are liable for any damage to or deterioration of the Bycyklen frame, its screen or the docking points during your rental if the damage or deterioration is caused by or attributable to negligence, a willful act or non-compliance on your part. You will be charged the amount equivalent to the price of repairing or purchasing a new Bycyklen bike and/or Bikeshare’s loss.
\r\n\r\n
Under similar terms, you will be held liable in the case of theft of your rented bike. You must contact the police to report the theft and inform Bikeshare about the theft immediately.
\r\n\r\n
Bikeshare must prove that the damage or deterioration is your fault and must document the size of any claim they make against you. Bikeshare is not entitled to deduct any such claim directly from your payment card. The claim will be charged separately. Any disputes between you and BikeShare will be settled in accordance with section 15.
\r\n\r\n
10. Non-compliance \r\nIf you do not meet your obligations under these terms, or if the bike is used in violation with the terms, Bikeshare is entitled to cancel your current trip with immediate effect and bar access to the bike share system.
\r\n\r\n
You are required to immediately hand over the bike in accordance with section 8 if Bikeshare requests its return on suspicion of non-compliance. You may not claim reimbursement or compensation. Bikeshare is also entitled to compensation for any loss suffered as a consequence of non-compliance.
\r\n\r\n
You are liable for any property damage or personal injury inflicted on a third party during the rental period.
\r\n\r\n
11. Limitation of Liability \r\nBikeshare is under no circumstances liable for any loss of profits or other incidental or consequential loss as a result of an accident in which a Bycyklen user is involved. Bikeshare is under no circumstances responsible for your or anyone else's use of the bike.
\r\n\r\n
In case of damage to persons and property caused by defects or errors on a bike (product liability), Bikeshare is only liable to the extent that liability results from mandatory legislation. This also applies in relation to product liability.
\r\n\r\n
In case of property damage, Bikeshare’s liability is limited to DKK 50,000 per damage. In case of injury, Bikeshare’s liability is limited to DKK 10 million per damage.
\r\n\r\n
Bikeshare cannot under any circumstances be held responsible for failing to fulfill its obligations under these terms and conditions if its non-compliance is due to circumstances which prevent
\r\n\r\n
Bikeshare from performing the service or which make performance of the service unreasonably burdensome, such as system failure or factors outside Bikeshare’s control (force majeure).
\r\n\r\n
12. Subcontractors and third parties \r\nBikeshare is entitled to use subcontractors. Bikeshare is also entitled to transfer rights and obligations to third parties.
\r\n\r\n
13. Changes to terms & conditions \r\nBikeshare holds no responsibility for printing and pricing errors. Bikeshare reserves the right to change these terms at one month's notice.

14. Applicable law and competent court \r\nAny dispute in terms of rental and usage of the Bycyklen and/or these terms and conditions is subject to Danish law and must be brought before the competent court of Bikeshare

More in details \r\nBycyklen won a public EU tender written by DSB in collaboration with Frederiksberg and Copenhagen municipalities in 2012. The metro company also contributed in handling the tender.

The tender was shared in accordance with all applicable rules, and up to the application deadline, several meetings were held where interested parties could meet and enter into collaborations if they so desired.
\r\n\r\n
One of the reasons why Bycyklen won the tender was that it was \"the most economically advantageous offer\". Furthermore, Bycyklen was visionary and offered some options that similar systems in other major cities could not offer - including reservation of bikes and handover of bicycles next to full Bycyklen stations.
\r\n\r\n
The ambition behind the new urban bicycle system was to establish a ”4. component in public transportation” that could transport the traveler the last mile between A and B.
\r\n\r\n
Specific functionalities of Bycyklen that support this ambition are:

Bycyklen is primarily a commuter bicycle which, with its minute/hour payment structure and the need for recharging, provides transport from A to B - unlike most regular rental bicycles, for example, which can be rented daily.

The subsidy for the City Bicycle is 95.8 million distributed over 8 years and is distributed as follows:

The approval of Bycyklen’s bikes and the allocation of the 40 million distributed over eight years was adopted by A, B, F, O, and Ø in the Copenhagen Municipality's \"Agreement on Budget 2014\" (p. 18).

Bikeshare Danmark A/S (Bikeshare) - the operating company that owns all hardware and is responsible for operation and customer service.

Bycyklen IT - a subsidiary of Bikeshare, which maintains and develops the fleet management system behind the City Bicycle system.

The City and Commuter bike Foundation (Foundation) - a private, commercial fund, founded by the contributors (DSB, Frederiksberg, and Copenhagen). The fund is the contract holder to Bikeshare and Bycyklen IT and the link to the contributors. The Foundation is also responsible for marketing of Bycyklen and distributing the Bycyklen-System to other cities.

Bikeshare and the Foundation each have their unique board of directors, who make overall strategic decisions on behalf of the companies.

Regulatory agreements

The relationship between the municipalities, DSB, and the Foundation is regulated through a cooperation agreement.
\r\n\t
The relationship between the Foundation and Bikeshare is regulated through a framework agreement.
\r\n\t
The relationship between the municipalities, DSB, and Bikeshare is thus handled by the Foundation in accordance with, respectively, the cooperation agreement and the framework agreement.
\r\n
\r\n\r\n
The framework agreement with the operator has also abolished the obligation to tender until 26 November 2019. This means that other municipalities can buy the capital's city bicycle system without having to carry out an independent tender - on terms that have already been exposed to competition.
\r\n\r\n
The City and Commuter bike Foundation’s contract ensures an economically sustainable model. The contract stipulates that Bikeshare must have a fixed price per trip and per unit of time. Any surplus in the Bycyklen-system can only be reinvested in accordance with the Foundation’s purpose, which is to invest in green mobility and reduce congestion. That is the development of the IT system, new/more bicycles, more Bycyklen stations, cheaper prices for users, or similar.
\r\n\r\n
Bycyklen is a so-called \" turn-key delivery\", where the operating company, Bikeshare owns all the hardware and IT, while the Foundation (on behalf of the contributors) owns the right to offer the system. The risk of vandalism, theft, etc. therefore lies with the operating company and not with the contributors.
\r\n\r\n
The purchase price of a Bycyklen including tablet is approx. 25.000 DKK. However, since the system is a turn-key delivery, it makes no sense to talk about a unit price for a City bike, with the price being IT development and bicycles, operation, repairs, redistribution, customer service, and much more over 8 years. In principle, this could mean that the entire bicycle fleet has changed when the contract period expires after 8 years - without the contributors having had an extra penny out of pocket. Bycyklen has paid for the development and setup of all infrastructure behind the system. This applies to both the IT system and the bicycles and the setup of Bycyklen Stations.
\r\n\r\n
As the winner of the 2012 offer, the City Bike has what you can call a \"universal service\". This means that there must be Bycyklen Stations and City Bicycles in places that are not necessarily densely populated and where commercial bike rental companies are typically absent as there is no money to be made there.
\r\n\r\n
The city bike is an ambitious solution that, with its motor assistance, opens up the possibility of getting users on the bike who would otherwise not normally dream of getting seated.
\r\n\r\n
The Bycyklen system is still in phase one and will be continuously expanded and developed and will make even better sense when more municipalities come along, and motor assistance comes even more into line with commuting across municipal boundaries. We are already in dialogue with several municipalities in the metropolitan area and are very much looking forward to presenting the next members of the Bycyklen-family.

By the way, the city bikes have nothing to do with the old \"coin-throwing city bikes.\" The former city bikes were operated by the Technical and Environmental Administration, which is not the case with the City bikes that are on the street now.

Bikeshare Danmark A/S indgiver konkursbegæring 9. december 2022
Bikeshare Danmark A/S er driftsselskabet bag Bycyklen, som findes i København, Frederiksberg og Rødovre Kommuner og ved en række S-togs- og Metro stationer.
Bikeshare har siden 2017 været ejet af By- og Pendlercykel Fonden. (Etableret af Københavns og Frederiksberg Kommuner), fordi den oprindelige ejer og stifter af Bycyklen gik konkurs.
Siden har der gennem de seneste godt fem år været arbejdet med at skabe en velfungerende og økonomisk bæredygtig forretning. Bikeshare har haft overskud alle år siden fondens overtagelse.
Driftstilskuddene er nu udløbet, og det har ikke været muligt at få kommunerne og DSB til at forlænge aftalen om driftstilskud, og der har heller ikke været opbakning til at fortsætte Bycyklen som reklamefinansieret. Derfor har Bikeshares bestyrelse dags dato indgivet konkursbegæring.
Bikeshare vil gerne takke for godt samarbejde med kunder og kreditorer, som trods forskellige udfordringer, som følge af eksempelvis Covid-19, hærværk, hacking m.m. har holdt ved.
Bikeshares bestyrelse er rigtig ærgerlige over på dette tidspunkt at måtte indgive konkursbegæring. Vi er lykkedes med at optimere hele virksomheden og har fået udviklet en ny cykel, som tager højde for mange af de børnesygdomme, der har været ved den oprindeligt udviklede cykel.
Det har kun kunnet lade sig gøre, fordi der gennem årene har været nogle ekstremt dedikerede medarbejdere, som har været kreative, løsningsorienterede og positive, uanset hvilke udfordringer, der har været på vejen.
Der forestår nu et oprydningsarbejde, som boet skal tage sig af, og kunderne kan desværre ikke benytte cyklerne.
